A 950: Provides for the award of reasonable attorneys' fees in FOIL proceedings if the person is successful and in open meeting proceedings to the successful petitioner and against the public body.
The bill aims to amend the Public Officers Law to award reasonable attorney's fees in certain proceedings. The court may assess fees against an agency involved in a case where the person has substantially prevailed after producing records voluntarily, or as a result of a court order. This can occur when the agency fails to respond to a request or appeal within the statutory time, or when the court finds that the agency had no reasonable basis for denying access. The court's assessment of fees is discretionary, but may be awarded in cases where a vote was taken in material violation of the law or substantial deliberations occurred in private prior to such a vote. The bill takes effect immediately.
