What S 1054 does, verified January 10, 2026

The bill aims to prohibit the use of head-mounted portable electronic devices while driving. A portable electronic device is defined as any device used to input, write, send, receive, or read text for present or future communication. The bill states that a person using a portable electronic device while driving is presumed to be using the device, unless evidence shows otherwise. The presumption is rebuttable and only applies to handheld devices, not head-mounted devices. Head-mounted devices, such as Google Glass, are exempt from the ban. The ban will take effect 30 days after the bill becomes a law.
