What S 10726 does, verified October 29, 2026

This act amends the Village Law and the Public Officers Law to allow the Village of Alden in Erie County to appoint a village clerk who is not a resident of the village itself. Under the new provisions, the village board of trustees may pass a resolution permitting the clerk to reside in Erie County or any adjoining county within New York State, rather than requiring residency within the village. The legislation also clarifies that these relaxed residency requirements apply specifically to the village of Alden, while maintaining the standard rule that clerks in other villages must remain residents of their respective municipalities unless otherwise authorized by law. The act takes effect immediately upon passage.
