S 1241: Enacts "Ildefonso Romero's law" to establish the felony offense of aggravated assault for the causation of serious physical injury to or death of, as the case may be, any person, with intent to cause physical injury to such person or a third person.
The bill proposes to establish a new felony offense called "aggravated assault". A person can be guilty of this offense if they intentionally cause serious physical injury or death to another person, or if they recklessly cause serious physical injury or death to another person. Additionally, a person can be charged with aggravated assault if they cause serious physical injury or death to another person with criminal negligence using a deadly weapon or a dangerous instrument. The penalty for aggravated assault would be a class E felony. The bill would take effect on the first of November next succeeding the date it becomes a law.

Short title. This act shall be known and may be cited as 2 "Ildefonso Romero's law". 3 § 2. The penal law is amended by adding a new section 120.00-a to read 4 as follows: 5 § 120.00-a Aggravated assault. 6 A person is guilty of aggravated assault when: 7 1. With intent to cause physical injury to another person, such person 8 causes serious physical injury or death to such other person or to a 9 third person; or 10 2. Such person recklessly causes serious physical injury or death to 11 another person; or 12 3. With criminal negligence, such person causes serious physical inju- 13 ry or death to another person by means of a deadly weapon or a dangerous 14 instrument. 15 Aggravated assault is a class E felony. 16 § 3.
