What S 1546 does, verified January 8, 2026

The proposed law aims to provide the New York Power Authority (NYPA) with the right of first offer and refusal for certain renewable generation facilities and the power or energy created by them. NYPA will be allowed to match the purchase price of renewable generation facilities and renewable energy projects at the time of sale. If NYPA decides to match the purchase price, it will assume the role of the sole purchaser of the facility or project. NYPA must make an offer to purchase within 30 days for facilities with a capacity of less than 25 megawatts and within 60 days for facilities with a capacity of 25 megawatts or more. This law does not affect the NYPA's existing authority under the Public Authorities Law. The law will take effect immediately.
