S 1677: Provides that entities soliciting a recurring contribution to a political campaign, political committee, party committee, or not-for-profit or for-profit entity shall receive the affirmative consent of the contributor at the time of arrangement of the recurring contribution; provides for refund of recurring contributions; provides penalties for violations.
The bill aims to protect consumers from unwanted recurring contributions by requiring explicit affirmative consent from contributors. Contributors must opt-in to recurring contributions, and the contributor can cancel at any time. Entities soliciting recurring contributions must provide clear and concise information about the contribution, including the ability to cancel, within 24 hours of the initial contribution and each recurring contribution. Entities that violate the provisions of the bill must return the entire amount of contributions made, minus the initial installment, and pay a civil fine equal to five times the amount of the contribution or $1,000, whichever is greater. The bill takes effect immediately.
