S 1692: Relates to commissaries and canteens at correctional institutions; provides that items for sale at a commissary or canteen shall be sold for no more than a certain percentage over the purchase price; provides that the department of corrections and community supervisions shall publish on its website the price list for all commissary items for sale at each institution as of June 1, 2026 and on an annual basis thereafter.
The state of New York is introducing a new law to allow commissaries or canteens in correctional institutions. The commissioner may authorize institutions to establish commissaries for the use and benefit of incarcerated individuals. Items sold at the commissary must be sold at no more than three percent over the purchase price. The state will maximize discounts by bulk purchasing and contracting opportunities, and will not receive commissions or revenue from these contracts. Profits from commissary sales will be deposited into a special fund and used for the institution's general purposes. Funds in an incarcerated individual's commissary account can only be used for purchases at the commissary, and no funds can be removed for penalties or other reasons. The new law takes effect immediately.
