  STATE OF NEW YORK ________________________________________________________________________ 2119 2025-2026 Regular Sessions  IN SENATE January 15, 2025 ___________ Introduced by Sen. FAHY -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT directing the commissioner of motor vehicles to conduct a study on the distribution of traffic fines The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The commissioner of motor vehicles shall conduct a study in 2 cooperation and consultation with the New York State Association of 3 Towns, the New York Conference of Mayors and Municipal Officials, and 4 the New York State Magistrates Association relating to the disposition 5 of fines and penalties as provided in section 1803 of the vehicle and 6 traffic law. Such study shall include, but not be limited to, an exam- 7 ination of the distribution of fine revenue according to the jurisdic- 8 tion over the highway where a violation occurred, the statute violated, 9 whether the statute violated is a state law or a local ordinance, and 10 the annual per capita monetary cap on revenues applicable to villages 11 and suburban towns. In conducting this study, such commissioner shall 12 examine particularly the fairness of the current law as it relates to 13 the disposition of fines collected for violations under title 7 of the 14 vehicle and traffic law, with special attention given to violations of 15 section 1180 of the vehicle and traffic law. 16 § 2. Upon completion of the study but no later than the thirty-first 17 of December next succeeding the date on which this act shall have become 18 a law, the commissioner of motor vehicles shall submit a report based on 19 the findings of the study to the governor, the temporary president of 20 the senate, the speaker of the assembly, the minority leader of the 21 senate, the minority leader of the assembly, the chair of the senate 22 transportation committee, and the chair of the assembly transportation 23 committee which shall include the findings of the study as well as 24 recommendations for statutory changes that may be implemented in order 25 to ensure a more equitable distribution of revenue for violations of EXPLANATION--Matter in italics (underscored) is new; matter in brackets [ ] is old law to be omitted.
