The state of New York is introducing a new law that prohibits the participation of certain law enforcement agencies in the 1033 federal excess property program for the purpose of receiving lethal or offensive weapons. The law aims to prevent the distribution of such weapons to local police departments, county sheriff's offices, and state police agencies. The city of New York is exempt from this rule, but only for counterterrorism purposes as determined by the state division in consultation with the US Department of Homeland Security. The state division must annually publish a public report on the state of participation in the 1033 federal excess property program, which will be made available to the governor, the state legislature, and the attorney general.
