New York · Senate · 2025–2026 Legislative Session · last verified January 8, 2026

What S 2257 does, verified January 8, 2026

The bill aims to extend the time period for individuals to request a fair hearing after receiving notification of their medical professional's disability determination. Applicants or recipients of public assistance benefits will have 60 days to request a fair hearing after receiving this notification, or 60 days after receiving a work activity assignment. If an individual timely requests a fair hearing, no work activity assignment can be made or enforced until the hearing is determined. However, if the social services district suspects that the individual does not actually suffer from a work-limiting condition, the district must provide notice of potential sanctions. Recipients will be subject to sanctions if the district determines that there is no basis for their claim and they intentionally misrepresented their medical condition. The bill takes effect immediately.
