  STATE OF NEW YORK ________________________________________________________________________ 2354 2025-2026 Regular Sessions  IN SENATE January 16, 2025 ___________ Introduced by Sen. PARKER -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to the definition of eligible vehicles for climate smart community projects The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subparagraph (i) of paragraph c of subdivision 1 of section 2 54-1521 of the environmental conservation law, as amended by section 1 3 of part CCC of chapter 55 of the laws of 2021, is amended to read as 4 follows: 5 (i) has up to four wheels; 6 § 2. Paragraph b of subdivision 3 of section 54-1521 of the environ- 7 mental conservation law, as added by section 1 of part CCC of chapter 55 8 of the laws of 2021, is amended to read as follows 9 b. The department, in consultation with the New York state energy 10 research and development authority, shall determine the amount of the 11 rebate taking into consideration the electric range of the vehicle and 12 the estimated annual greenhouse gas emissions reductions provided by 13 that vehicle as compared to a similar internal combustion engine 14 vehicle, provided that a rebate of an eligible purchase shall be not 15 less than two thousand five hundred dollars per vehicle and not more 16 than [seven] five thousand [five hundred] dollars per vehicle. 17 § 3.
