What S 2410 does, verified January 8, 2026

The bill aims to prohibit the use of a waiver of probate form in the state of New York. A waiver of probate is a sworn document executed by a deceased person's heirs or beneficiaries to bypass formal estate proceedings. The bill deems the use of such a waiver as prohibited in the state, and transfer agents are not allowed to accept it as proof of entitlement to an asset or assets. The waiver cannot be accepted even with a valid medallion signature guarantee. Instead, it will be considered as supporting evidence of a person's claim of entitlement to an asset or assets or to verify a person's identity and/or relationship to a deceased owner of an asset or assets. This provision applies to all persons who are residents of the state at the time of their death.
