STATE OF NEW YORK ________________________________________________________________________ 2620 2025-2026 Regular Sessions IN SENATE January 21, 2025 ___________ Introduced by Sen. SCARCELLA-SPANTON -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the criminal procedure law, in relation to designating certain employees of the New York city department of buildings as peace officers; and to amend the penal law, in relation to assaulting certain employees of the New York city department of buildings The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 2.10 of the criminal procedure law is amended by 2 adding a new subdivision 88 to read as follows: 3 88. Employees of the New York city department of buildings designated 4 by the commissioner when acting pursuant to their duties as established 5 in chapter twenty-six of the New York city charter; provided, however, 6 that nothing in this subdivision shall be deemed to authorize such offi- 7 cer to carry, possess, repair or dispose of a firearm unless the appro- 8 priate license therefor has been issued pursuant to section 400.00 of 9 the penal law. 10 § 2. Section 120.05 of the penal law is amended by adding a new subdi- 11 vision 3-d to read as follows: 12 3-d. With the intent to prevent an employee of the New York city 13 department of buildings in an inspectorial, technical, and/or investi- 14 gative title from performing such employee's lawful duties, such indi- 15 vidual causes physical injury to such employee; or 16 § 3.
