What S 305 does, verified January 12, 2026

The bill proposes to amend the workers' compensation law to establish statutory guidelines for return to work by temporarily partially disabled workers. In cases of temporary partial disability, the compensation will be two-thirds of the difference between the injured employee's average weekly wages before the accident and their wage earning capacity after the accident. The compensation will be payable during the duration of the temporary partial disability, without the necessity for the injured employee to demonstrate ongoing attachment to the labor market, unless the board finds that the separation is wholly unrelated to the compensable injury. The changes will take effect immediately.
