The state of New York proposes an amendment to the Highway Law to clarify the liability of the state for damages caused by defects in state highways. The state will not be liable for damages suffered by persons from defects in state highways, except for certain conditions. The liability for damages will remain as currently provided by law, but the state will maintain a minimum width of pavement in incorporated villages where it has constructed or improved highways. The state will be liable for damages to persons or property only when such damage occurs as a result of the defective condition of the portion of improved highway maintained by the state. The state will not be liable for defects in bridges over which the state has no control.
