S 382: Adds fetal alcohol spectrum disorders to the definition of developmental disability.
The bill aims to add fetal alcohol spectrum disorders (FASD) to the definition of developmental disabilities in New York State. FASD includes conditions such as fetal alcohol syndrome, partial fetal alcohol syndrome, and alcohol-related neurodevelopmental disorder. To be considered under this clause, a person must be over 7 years old, have a FASD qualifying diagnosis by a provider, have an onset of the condition prior to age 22, exhibit a likelihood of indefinite continuation, and have a diagnosis with a substantial impact on daily living activities. The bill takes effect 24 months after it becomes a law.

Subparagraph 1 of paragraph (a) of subdivision 22 of 2 section 1.03 of the mental hygiene law, as amended by chapter 114 of the 3 laws of 2017, is amended to read as follows: 4 (1) is attributable to intellectual disability, cerebral palsy, 5 epilepsy, neurological impairment, familial dysautonomia, Prader-Willi 6 syndrome, fetal alcohol spectrum disorders including fetal alcohol 7 syndrome, partial fetal alcohol syndrome (pFAS), and alcohol-related 8 neurodevelopmental disorder (ARND), or autism; 9 § 2.
