S 4114: Increases the frequency that visitation or inspections of facilities operated or licensed by the office for people with developmental disabilities must be made each year.
The proposed law aims to increase the frequency of visitation and inspection of mental health facilities in New York. The review process will include periodic visitation and inspection of each facility, which will be conducted at least three times per year without prior notice. In facilities with a history of compliance and high-quality care, inspections can be conducted twice a year without notice, but the commissioner must provide notice to the applicable board of visitors. Inspectors may be accompanied by independent monitors from the board of visitors or other approved individuals. The areas of review will include physical plant, fire safety, health care, protective oversight, abuse and neglect prevention, and reporting procedures. The law will take effect immediately.
