Senate BillIntroduced
S 5420: Expands the class A misdemeanor of public lewdness in the first degree to include the commission of public lewdness after having been convicted of a public lewdness offense in the previous 3 years.
What S 5420 does, verified January 8, 2026
The bill aims to amend the penal law to expand the definition of public lewdness in the first degree. A person is considered guilty of this crime if they commit public lewdness and have been convicted of a similar offense within the past three years or have been convicted of this crime itself within the past three years. This expanded definition would increase the penalties for individuals who repeatedly commit public lewdness offenses. The bill would take effect on the first of November next succeeding the date of its enactment.
