What S 5423 does, verified January 8, 2026

The bill aims to amend the agriculture and markets law to address the judicial process for handling dogs that cause death to companion animals, farm animals, or domestic animals while trespassing on property. The bill introduces a new aggravating circumstance under which a judge or justice may order humane euthanasia or permanent confinement of a dog if it is found to be dangerous and has caused the death of an animal on someone else's property. This new circumstance includes situations where the dog attacks a person, has a known vicious propensity, or causes death to an animal while trespassing. The bill also allows for the automatic stay of an order of humane euthanasia pending the outcome of an appeal, and it takes effect 90 days after it becomes a law.
