S 5471: Codifies the duty of real estate brokers to supervise salespersons and associate brokers through regular, frequent and consistent personal guidance, instruction and oversight; lists elements of supervision including the ability to familiarize salespersons with state and federal laws against discrimination.
The bill aims to amend the Real Property Law to improve the supervision of real estate salespersons and associate real estate brokers by licensed brokers. A licensed real estate broker is required to exercise reasonable and adequate supervision over their salespersons and associate brokers through regular, frequent, and consistent personal guidance, instruction, and oversight. The supervision should be determined by factors such as the availability of the supervising broker to review and approve documents, the distance between the supervising broker's main location and branch offices, and the broker's ability to familiarize salespersons and associate brokers with federal and state laws governing real estate transactions. A broker who fails to exercise reasonable supervision or retains benefits from a transaction involving a salesperson's misconduct may be subject to penalties. Additiona…
