Senate BillIntroduced

S 5719: Ensures reimbursement practices of pharmacy benefit managers do not allow for reimbursement of an amount less than the cost of procuring the drugs.

New York · Senate · 2025–2026 Legislative Session · last verified January 8, 2026

What S 5719 does, verified January 8, 2026

The bill aims to improve reimbursement rates for pharmacies in New York State. It requires pharmacy benefit managers to reimburse pharmacies for therapeutically equivalent drugs at a price equal to or less than the maximum allowable cost. If a pharmacy cannot purchase a challenged drug at this price, the pharmacy benefit manager must adjust its pricing methodology to match the pharmacy's acquisition cost. Pharmacies can then reverse and rebill affected claims. The bill also prohibits pharmacy benefit managers from reimbursing pharmacies less than the amount they reimburse their affiliates for the same services. The reimbursement amount is calculated on a per-unit basis based on the same generic product. The bill takes effect 90 days after it becomes a law.
