S 5787: Prohibits membership warehouse stores from selling to a retailer.
The bill aims to regulate the sale of alcoholic beverages by membership warehouse stores. A new subdivision is added to the Alcoholic Beverage Control Law to define a "membership warehouse retailer" as a store that limits access to its members, including businesses and individuals who pay a fee to shop in the club. The bill also prohibits membership warehouse retailers from selling alcoholic beverages to retailers who present a corporate or business card, debit, credit, or membership card bearing the name of a retailer at the point of sale. The penalties for violating this rule include a written notice and warning, suspension, and imposition of a civil penalty, as well as revocation or cancellation of a license to sell alcoholic beverages.
