S 5853: Establishes the crime of criminal possession of a flamethrower as a class E felony.
The proposed law aims to add possession of a flamethrower to the crime of criminal possession of a weapon in the fourth degree. A flamethrower is defined as a device capable of projecting a stream of burning fuel at least three feet. The law excludes inoperable display units and historical flamethrowers made before 1916. Historical flamethrowers are defined as those constructed with at least five significant components manufactured before 1916. Significant components include fuel cells, gas caps, pressure regulators, and other necessary parts. The law prohibits the possession of flamethrowers, but allows for the manufacture, restoration, or alteration of components. This law is a class E felony. The law takes effect 120 days after it becomes law.
