S 6449: Relates to interest to be recovered upon a sum awarded in certain circumstances.
The bill aims to amend the civil practice law and rules in New York. It makes changes to interest calculation in certain cases. In cases where a breach of contract or interference with property is involved, interest can be recovered on a sum awarded. The date from which interest is computed must be specified in the verdict, report, or decision. For cases involving bodily injury, interest is computed from the date of injury or loss. If a jury is discharged without specifying the date, the court can fix the date upon motion. In cases where the date is certain and not in dispute, the clerk of the court can fix the date upon affidavit. The amount of interest is computed by the clerk to the date the verdict was rendered or the report or decision was made, and included in the total sum awarded. The changes take effect immediately.
