S 659: Relates to the general civil penalty of the environmental conservation law; provides that in addition to the fines, such person may be enjoined from continuing such violation and any permit or certificate issued to such person may be revoked or suspended, or a pending renewal application may be denied.
The proposed legislation aims to amend the environmental conservation law to increase the general civil penalty for individuals or organizations that violate environmental regulations. Violators may be liable for a maximum of one thousand dollars in civil penalties, plus an additional one thousand dollars for each day the violation continues. In addition to civil penalties, violators may be prohibited from continuing the violation, and any permits or certificates issued to them may be revoked or suspended. The proposed changes allow for a hearing or opportunity to be heard before assessing any civil penalties or permit actions. The changes take effect immediately upon enactment.
