The bill proposes to establish two new crimes in New York State: deceptive wearing of a mask and aggravated deceptive wearing of a mask. Deceptive wearing of a mask is defined as loitering in a public place while disguised by a mask or unusual attire, with the intention of deceiving others about one's identity or intentions. This crime is a class B misdemeanor. Aggravated deceptive wearing of a mask is defined as engaging in deceptive wearing of a mask while causing injury to a person, damage to property, or theft of property. This crime is a class A misdemeanor. The bill also provides exceptions for the use of masks for religious observance, customs, or in connection with masquerade parties or similar events, as long as permission is obtained from the authorities. The bill takes effect on the ninetieth day after it becomes a law.
