Senate BillIntroduced
S 726: Waives the state's sovereign immunity in state and federal courts with regard to liability for violations of the Americans with Disabilities Act of 1990, the Fair Labor Standards Act, the Age Discrimination in Employment Act, and the Family and Medical Leave Act; waives the immunity of all instrumentalities and political subdivisions of the state.
What S 726 does, verified May 14, 2026
The state of New York is waiving its sovereign immunity to claims under several federal laws. The waiver applies to the Americans with Disabilities Act, the Fair Labor Standards Act, the Age Discrimination in Employment Act, and the Family and Medical Leave Act. This means that the state will no longer be immune from lawsuits related to these laws in state and federal courts. The provisions of these federal laws will now apply to the state, its agencies, and its subdivisions. The waiver takes effect immediately.
