What S 7440 does, verified September 28, 2025

The bill aims to amend the civil practice law and rules in New York. It introduces a new condition under which an arbitration award can be vacated, specifically when an arbitrator has evidenced a "manifest disregard of the law" in rendering the award. This means that if an arbitrator consistently disregards the law, the award can be challenged. The bill also clarifies that a party can only vacate an award if they continued with the arbitration after noticing the defect, without objecting. The new provision aims to promote fairness and justice in arbitration proceedings.
