New York · Senate · 2025–2026 Legislative Session · last verified July 2, 2025

What S 804 does, verified July 2, 2025

The bill aims to amend the General Business Law to improve the notification process of data breaches in New York. It requires entities that handle sensitive information to notify the Department of Financial Services (DFS) along with other relevant authorities, including the State Attorney General, Department of State, and Division of State Police, when New York residents are affected. The notice must include the timing, content, and distribution of the notification, as well as the approximate number of affected individuals. The bill ensures that entities provide the notice without delaying the notification to affected residents. The changes will take effect on the same date as a separate amendment to the General Business Law.
