What S 8213 does, verified September 28, 2025

The proposed law aims to improve the consideration of capital expenditures in utility rate proceedings. It requires that proposed capital expenditures be described in detail, including purpose, total cost, expected period of usefulness, location, rationale for inclusion, and anticipated benefits to ratepayers. These descriptions must be posted on the commission's website. The burden of proof to show that a change in rates related to each capital expenditure is just and reasonable falls on the utility. The law will take effect immediately, but it will not apply to matters involving a change in rates that were initiated before its effective date.
