What S 8375 does, verified February 5, 2026

The Small Cannabis Farmer Relief Act aims to provide relief to distressed cannabis farmers by allowing them to expand their cultivation canopy. Licensees who qualified as distressed farmers and cultivated cannabis in 2022 or 2023 can expand their canopy to up to twice the maximum square footage they cultivated during those years. This expansion is subject to the maximum limits established by the corresponding cultivation tier and does not require additional fees. Microbusiness licensees who previously held an adult-use conditional cultivator license are also eligible for canopy expansion. The provisions of this act expire on December 31, 2028, when they are deemed repealed.
