What S 8728 does, verified January 12, 2026

The proposed law aims to regulate the sale of slushies made with liquor, wine, beer, or cider in New York. To sell these slushies, retailers must prominently display warning labels and signs indicating that the product contains alcohol and is not suitable for individuals under 21 years old. These labels must include information about the risks of alcohol consumption during pregnancy and the potential for impaired driving and health problems. Manufacturers and distributors of these slushies must also provide retailers with written notices and copies of the required warning labels. The sale of these slushies to individuals under 21 years old is prohibited, and retailers found violating this rule may face administrative and/or criminal prosecution. The law applies to all slushies made with liquor, wine, beer, or cider, regardless of the percentage of alcohol content.
