Senate BillIntroduced
S 875: Relates to burglary in the second degree; adds language where the building is a dwelling which, at the time of the commission of the crime, is occupied by a person who is not a participant in the crime to what constitutes burglary in the second degree.
What S 875 does, verified January 8, 2026
The proposed law aims to strengthen New York's burglary laws. It expands the definition of a dwelling to include a building occupied by someone other than the perpetrator, making it easier to prosecute burglaries. Additionally, the law adds burglary to the list of class C violent felony offenses, which would increase penalties for such crimes. The new classification would also make it easier to prosecute individuals who commit burglary in the second degree. The law takes effect immediately.
