What S 905 does, verified January 8, 2026

The proposed law aims to improve the treatment of incarcerated individuals with mental illness. It requires the department to divert or remove these individuals from segregated confinement to a residential mental health treatment unit if they have been diagnosed with a serious mental illness. This diversion process should occur within 30 days of diagnosis or any subsequent assessment. The law also specifies that the diagnosis must be based on the most recent edition of the diagnostic and statistical manual of mental disorders. The law does not prevent disciplinary proceedings from occurring, but ensures that the individual receives proper treatment. The proposed law takes effect 30 days after it becomes a law.
