To amend section 4301.13 of the Revised Code to 1
allow retail liquor permit holders to offer a 2
discount on dealcoholized wine under specified 3
circumstances. 4
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 4301.13 of the Revised Code be 5
amended to read as follows: 6
Sec. 4301.13. (A) The liquor control commission may adopt, 7
promulgate, repeal, rescind, and amend rules to regulate the 8
manner of dealing in and distributing and selling bottled wine 9
within the state. The commission may require out-of-state 10
producers, shippers, bottlers, and holders of federal importers' 11
permits shipping bottled wine into Ohio and holders of A-2, A- 12
2f, B-5, B-3, and B-2 permits issued by the division of liquor 13
control, engaged in distributing and selling bottled wine in 14
Ohio, to file with the division a schedule of prices in which 15
minimum prices are set forth for the sale of bottled wine at 16
wholesale or retail, or both, in Ohio. Any amendments, 17
additions, alterations, or revisions to the schedule of prices 18

as originally filed with the division shall be filed in the same 19
manner as the original schedule of prices required to be filed 20
with the division. 21
(B)(1) As used in division (B)(2) of this section: 22
(a) "Case" means not less than six and not more than 23
twelve bottles of wine, which need not be of the same brand, 24
variety, or volume. 25
(b) "Dealcoholized beverage" means wine that has been 26
processed to remove its alcohol so that the beverage contains 27
less than one-half of one per cent of alcohol by volume. 28
(2) The commission may determine and fix the minimum mark- 29
ups at wholesale or retail, or both, for bottled wine, and fix 30
the minimum prices at which the various classes of bottled wine 31
shall be distributed and sold in Ohio either at wholesale or 32
retail, or both. With regard to the minimum prices at which 33
various classes of bottled wine are sold in the state at retail, 34
the commission shall allow a retail permit holder to offer to a 35
personal consumer a ten per cent discount off the per-bottle 36
retail sale price on each bottle included in a case of that wine 37
that is offered for sale. 38
(2) As used in division (B)(1) of this section, "case" 39
means not less than six and not more than twelve bottles of 40
wine, which need not be of the same brand, variety, or volumeIn 41
conjunction with the discount on a case of wine, the commission 42
shall allow a retail permit holder to offer a ten per cent 43
discount off the per-bottle retail sale price on each bottle of 44
dealcoholized beverage that is offered for sale if the person 45
purchases the dealcoholized beverage as part of the same 46
transaction in which the person purchases a case of wine. 47
