HB 605: Codify the Spearin doctrine in public construction contracts
This bill introduces a new section to the Ohio Revised Code that codifies the Spearin doctrine in public construction contracts. The doctrine states that an owner's implied warranty that the provided plans and specifications are full, accurate, and sufficient for the completion of a project is void if the owner fails to provide adequate plans or specifications. To avoid liability, a contractor must follow the provided plans and specifications precisely, and their reliance on them must be reasonable. However, if a contractor discovers a defect or omission in the plans or specifications during a presite inspection, they are not liable for damages resulting from the defect.
