SB 342: Prohibit certain clauses from conservancy district contracts
This bill aims to protect conservancy districts from unfair contractual obligations. It prohibits contracts for goods and services from including provisions that require indemnification or limit liability for certain types of damages. These prohibited provisions include indemnification for negligence, intentional acts, or tortious conduct, as well as provisions that bind the district to unknown terms or conditions. The bill also prevents contracts from limiting a conservancy district's ability to recover costs for replacing a contractor. If a contract contains these prohibited provisions, they are considered void, and the contract remains enforceable without them.
