AB 1148: Food packaging: hazardous chemicals.

This bill aims to protect public health by prohibiting the distribution, sale, or offering for sale of food packaging containing certain hazardous chemicals. Starting January 1, 2027, it will be illegal to manufacture, distribute, or sell food packaging with intentionally added bisphenols or ortho-phthalates. The California Department of Toxic Substances Control will establish a threshold for naturally occurring bisphenols or ortho-phthalates in food packaging. After the threshold is set, the manufacture, distribution, or sale of food packaging with levels above the threshold will also be prohibited. The Department of Toxic Substances Control and the Attorney General will enforce these regulations, with penalties not exceeding $5,000 for the first offense and $10,000 for subsequent offenses.
