AB 1162: Challenges to housing and community-serving projects.
The bill aims to amend the California code of civil procedure to expand the type of civil actions for which motions for undertaking may be filed. Currently, a defendant can seek an order requiring a plaintiff to furnish an undertaking to secure costs and damages if the action would prevent or delay a housing development project. The bill would extend this provision to include actions that challenge community-serving projects, defined as projects that provide essential services to the community. This change would allow defendants to seek an undertaking to secure costs and damages if the action would delay or prevent a community-serving project.
