AB 1595: Criminal procedure: writs of habeas corpus and motions to vacate.
This bill revises the standards for writs of habeas corpus and motions to vacate. It requires a demonstration that new evidence has a reasonable probability of producing a different outcome, rather than just being material or conclusive. The bill also changes the process for concessions and prohibits withdrawing them in open court or in pleadings. It allows petitioners to overcome procedural bars by identifying changes in law or new evidence that create a reasonable probability of a different result. Additionally, the bill revises the definition of "exonerated" to include only convictions that were reversed on appeal due to insufficient evidence, and expands the definition to include exonerations of juvenile delinquency adjudications.
