AB 2140: Healing arts: reports: claims against licensees.
This bill would amend the state's professional liability reporting requirement for certain licensed professionals. Currently, licensees who do not have professional liability insurance must report settlements or judgments over $3,000 for death or personal injury caused by negligence within 30 days to the licensing agency. The proposed bill would increase this minimum reporting threshold to $3,000. For certain marriage and family therapists, clinical social workers, and professional clinical counselors, the current reporting threshold is $10,000. The proposed bill would also increase this threshold to $10,000. Failure to report settlements or judgments within the required timeframe would result in a fine of at least $50 and up to $500. The proposed bill would increase the minimum fine to $100.
