AB 2363: Individual Shared Responsibility Penalty: exemption.

This bill would exempt individuals from the individual shared responsibility penalty for not having health insurance if their household member, who would normally be subject to the penalty, was enrolled in Medi-Cal in 2024 or 2025.

The penalty is currently imposed on individuals who fail to maintain minimum essential health insurance coverage, as determined and collected by the state. However, this bill would provide a one-time exemption for individuals who meet the Medi-Cal enrollment criteria.

According to the existing law, individuals who are California residents are required to have minimum essential health insurance coverage for themselves and their dependents, starting from January 1, 2020. The exemption under this bill would only apply if a household member was enrolled in Medi-Cal during a specific time period.
