The bill would require the approval of the Department of Housing and Community Development before enforcing any such restriction. The definition of "reducing the intensity of land use" is also revised to include any action that individually or cumulatively reduces a site's residential development capacity. The bill applies retroactively to any pending action or proceeding, and the statute of limitations for enforcing the provisions is 3 years.
