AB 321: Misdemeanors.

This bill would amend the penal code to make a crime a misdemeanor when the court determines it is a misdemeanor prior to trial. Currently, a crime is considered a misdemeanor if the court decides it is one at or before the preliminary examination or before a certain order is filed. The bill would expand this provision to include any time the court makes this determination prior to trial. Additionally, the bill would require a subsequent motion to be made only upon a showing of changed circumstances following a denial of a motion under this provision.
