AB 704: Criminal records: destruction.

This bill would allow individuals who were arrested or convicted of nonviolent offenses before the age of 26 to petition the court to seal and destroy their records after four years have elapsed since their arrest or completion of their sentence. The court would also be required to order local law enforcement agencies to seal and destroy their records. The bill excludes certain serious and violent felonies, sex offenses, and offenses that may be used to increase a sentence from being considered eligible offenses. If the commission determines that the bill contains mandated costs, reimbursement for those costs would be made according to state statutes.
