AB 853: California AI Transparency Act.

The California AI Transparency Act requires certain entities to provide transparency about their artificial intelligence systems. A person creating a generative AI system with over 1 million monthly visitors must provide an AI detection tool that allows users to assess whether content was created or altered by the AI system. The AI detection tool must also output system provenance data detected in the content. The bill delays the operation of the transparency act until August 2, 2026, and requires large online platforms to detect whether content embedded with compliant provenance data is distributed on their platform. Starting January 1, 2028, capture device manufacturers must provide users with the option to include a latent disclosure in content captured by their devices, conveying certain information such as the device's name.
