SB 1342: Criminal records: relief.
This bill amends the state's criminal records law to provide relief to individuals who have been arrested but not convicted of a crime. The law currently requires a dismissal of the charge to be eligible for relief, but the bill would expand eligibility to anyone who was arrested on or after January 1, 1973, and had the charge dismissed. The bill also changes the way the state determines if a person is currently serving a sentence or if there are pending criminal charges. The state would be required to review its records monthly and notify the court if a person is eligible for relief. The court would then be required to grant relief and provide a register of action to the individual. The bill also prohibits courts from disclosing information about convictions that have been granted relief, except to the individual or a law enforcement agency.
