What SB 386 does, verified December 13, 2025

This bill requires health care service plans and health insurers to have a non-fee-based default method of payment for dental services. A dental provider must obtain affirmative consent to opt in or opt out of fee-based payments. The decision applies to the entire practice and all products or services covered. The bill does not apply if a health care service plan or insurer has a direct contract with a provider allowing them to choose payment methods. The provisions take effect on April 1, 2026, and apply to contracts and policies issued, amended, or renewed after that date.
