What SB 40 does, verified December 13, 2025

The bill aims to improve health care coverage by regulating insulin costs. It prohibits health care service plans and insurance policies from imposing copays, coinsurance, or deductibles higher than $35 for a 30-day supply of insulin, unless it is medically necessary. Starting in 2026, health care service plans and insurance policies cannot impose step therapy as a prerequisite for insulin coverage. Large group plans must include at least one insulin form in each drug type in their formulary. The $35 cap can be higher for tier 3 insulin if the formulary is grouped into tiers. Additionally, the bill requires reimbursement for costs mandated by the state, but excludes reimbursement for certain costs.
