The proposed law aims to regulate the use of generative artificial intelligence (AI) in the practice of law and arbitration. An attorney using AI must ensure that confidential information is not entered into a public AI system and verify the accuracy of AI-generated material. They must also correct any errors and take responsibility for the output. In arbitration, a neutral arbitrator cannot delegate decision-making to AI tools, and they must disclose any potential conflicts of interest. The arbitrator must also assume full responsibility for the award, regardless of AI assistance. The law prohibits the use of AI-generated citations in court filings without personal verification by the attorney. This ensures that attorneys and arbitrators are aware of the content and accuracy of the material they use.
